Tipsie — Terms of Use

These Terms of Use ("Terms") are an agreement between you and Sweet Studio ("we", "us", "our"), the developer of Tipsie: AI Character Chat for iOS ("Tipsie", "the App"). By downloading or using the App you agree to these Terms and to our Privacy Policy (meetevia.com/ios/privacy). If you do not agree, do not use the App. Questions: choizzyio@gmail.com.

1. ELIGIBILITY

Tipsie is for users aged 13 and over. By using the App you confirm that you are at least 13 years old. If you are between 13 and 17, you may use the App only with the consent of a parent or legal guardian, who accepts these Terms on your behalf. Where local law sets a higher age of digital consent (up to 16 in parts of the European Economic Area), you need that consent until you reach that age. We may close accounts that do not meet these requirements.

2. WHAT TIPSIE IS

Tipsie is interactive fiction for entertainment. You roleplay stories with fictional characters, create your own characters, and receive AI-generated text, images, videos and voice notes.

- You are talking to AI, not a person. Every character is fictional and powered by artificial intelligence. Characters are not real people, do not have feelings, and any resemblance to real persons is unintentional. - AI makes mistakes. Replies and media may be inaccurate, inconsistent, unexpected or inappropriate. Do not rely on them for decisions. - Not professional advice. Tipsie does not provide medical, mental health, legal, financial or any other professional advice and is not therapy or a substitute for it. - Not for emergencies. If you are in danger, thinking about suicide or self-harm, or someone else is at risk, contact local emergency services right away. 3. YOUR ACCOUNT

The App creates an account automatically on your device; you can also sign in with Apple. You are responsible for activity on your device and account. You can ask us to delete your account at any time at choizzyio@gmail.com. Deleting your account does not cancel an Apple subscription (see Section 7).

4. CONTENT RULES

Tipsie is a safe-for-work romance app. You must not use it to create, request, upload or share content that: - sexualizes or involves minors in any way, or presents a character as under 18 in a romantic or sexual context (zero tolerance; we report child sexual abuse material to the authorities); - is sexually explicit or contains nudity; - depicts, impersonates or targets a real, identifiable person without their consent, including deepfakes, celebrity likenesses and photos of other people; - promotes or gives instructions for self-harm, suicide, eating disorders, violence, terrorism, or illegal activity; - is hateful, harassing, threatening, or discriminatory; - infringes copyright, trademarks or other rights, including using characters you do not have rights to; - tries to bypass our safety systems, extract system prompts, scrape, reverse engineer, overload or resell the App or its providers.

We use automated filters and human review where needed. We may block, edit or remove content, limit features, or suspend or close accounts that break these rules, with or without notice where the law allows.

5. REPORTING AND BLOCKING

You can report any chat or character in the App (open the menu in a chat or on a character profile > Report). You can also write to choizzyio@gmail.com. We review reports within 7 days and act on them, which may include removing content and closing the responsible account. Reports about minors or illegal content are handled first.

6. YOUR CONTENT AND CHARACTERS

You keep ownership of what you write and the characters you create ("Your Content"). To run the App you give us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce and display Your Content, and to send it to our service providers, only as needed to operate, moderate, secure and improve the App. If you make a character public, this license also lets other users chat with it and lets us show it in the App and in our app store and marketing materials; you can make it private or delete it at any time, which ends these uses going forward. You confirm you have the rights to Your Content and that it follows Section 4.

AI-generated outputs created for you may be used by you for personal, non-commercial purposes. Similar outputs may be generated for other users. You must not present AI outputs as human-made where that would mislead others, and you must follow the content rules when sharing them.

Copyright complaints: send the work, the location of the infringing material in the App, your contact details and a statement of good faith to choizzyio@gmail.com with "Copyright" in the subject. We remove infringing material and close the accounts of repeat infringers.

7. PURCHASES, GEMS AND SUBSCRIPTIONS

All purchases are made through Apple's App Store with your Apple Account and are subject to Apple's terms.

Gems (virtual currency) - Gems let you use paid features such as messages, images, videos and voice. The cost of each feature is shown in the App before you use it. - Gems are a limited license to use features in the App. They have no cash value, cannot be exchanged for money, transferred or sold, and do not expire. - Gems are used up when you spend them. Except where the law or Apple's policies require otherwise, purchases are final.

Auto-renewing subscriptions - The App offers auto-renewing subscriptions (for example weekly, monthly or yearly). The title, length, price and what is included are shown on the purchase screen before you subscribe. - Payment is charged to your Apple Account when you confirm the purchase. - The subscription renews automatically at the same price and length unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period. - You can manage or cancel subscriptions in iOS Settings > [your name] > Subscriptions. Cancelling stops future renewals; you keep access until the end of the paid period. - If a free trial is offered, any unused part of it ends when you buy a subscription. - If we change a subscription price, Apple will notify you in advance and, where required, ask for your consent.

Refunds Apple handles all refunds under its policies; request one at reportaproblem.apple.com. EU and UK consumers: by starting to use digital content or a subscription immediately after purchase, you agree that it is supplied right away, and you acknowledge that you lose your 14-day right of withdrawal for that content once supply has started.

Restore purchases: Me > Settings > Restore purchases.

8. OUR RIGHTS

The App, its software, design, brand, built-in characters and content (except Your Content) belong to Sweet Studio or its licensors. We grant you a personal, revocable, non-transferable license to use the App on Apple devices you own or control, under these Terms and Apple's Usage Rules. We may change, add or remove features, characters and prices, and may suspend the App for maintenance or safety.

9. DISCLAIMERS

To the extent permitted by law, the App is provided "as is" and "as available". We do not promise that it will be uninterrupted, error-free or that AI outputs will be accurate or suitable for any purpose. Nothing in these Terms limits rights you have as a consumer that cannot be excluded by law.

10. LIMITATION OF LIABILITY

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill. Our total liability for any claim relating to the App is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) EUR 100. These limits do not apply to liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or to any other liability that cannot be limited by law.

11. INDEMNITY

To the extent permitted by law, you agree to compensate Sweet Studio for claims, losses and reasonable costs arising from Your Content or your breach of these Terms or the law. This section does not apply to consumers where local law does not allow it.

12. ENDING THESE TERMS

You can stop using the App and ask us to delete your account at any time. We may suspend or close your account if you break these Terms, if required by law, or if we stop offering the App; where reasonable we will give notice. If we close the App for reasons other than your breach, we will tell you in advance where possible. Sections 6 (license for content already shared, for the period needed to remove it), 9, 10, 11 and 14 survive.

13. APPLE TERMS

You obtained the App from the Apple App Store, so the following also applies, and controls if there is a conflict: - These Terms are between you and Sweet Studio only, not Apple. Apple is not responsible for the App or its content. - Apple has no obligation to provide maintenance or support for the App. - If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App. - Sweet Studio, not Apple, is responsible for any claims relating to the App or your use of it, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws. - If a third party claims that the App or your use of it infringes their intellectual property, Sweet Studio, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim. - You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. - You must comply with applicable third-party terms (for example your mobile data agreement) when using the App. - Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. LAW AND DISPUTES

These Terms are governed by the laws of Poland. Courts in Warsaw, Poland, have jurisdiction, except that if you are a consumer you may also bring claims in the courts where you live and you keep the protection of the mandatory laws of your country. EU consumers can also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Before going to court, please contact us so we can try to resolve the issue.

15. CHANGES

We may update these Terms. If a change is significant, we will tell you in the App at least 15 days before it takes effect. If you do not agree, you can stop using the App and delete your account; continuing to use it after the change takes effect means you accept the new Terms.

16. GENERAL

If any part of these Terms is unenforceable, the rest stays in effect. If we do not enforce a right, we do not waive it. You may not transfer these Terms; we may transfer them to a company that takes over the App, without reducing your rights. These Terms and the Privacy Policy are the entire agreement between you and us about the App.
